DATA PRIVACY POLICY K2 INVESTMENT INC.
Scope
To inform all our employees, contractors, clients, and generally all agents involved in the development of the business about the data privacy policies, to know, update, and rectify the information that has been collected about them and that is stored in the Databases or files of K2 in compliance with international information protection standards.
This policy applies to clients, employees, contractors, suppliers, and in general to third parties that have a direct or indirect relationship with K2.
It applies to all databases, files, websites, and personal information files that are in the possession of K2.
Data Privacy Policy Guidelines
K2, as the entity responsible for the data privacy management and in order to properly execute its activities and strengthen relationships with third parties, collects, stores, uses, circulates, transmits, transfers, updates, rectifies, and deletes personal data, including sensitive data, belonging to natural persons with whom it has or has had a relationship, such as workers, clients, suppliers, distributors, creditors both nationally and internationally.
Likewise, K2 protects the privacy of sensitive data of the information holders, understanding these as those that affect the holder's privacy or whose misuse can generate discrimination, such as those that reveal racial or ethnic origin, political orientation, religious or philosophical beliefs, union membership, social organizations, human rights or that promote interests of any political party or guarantee the rights and guarantees of opposition political parties, as well as data related to health, sexual life, and biometric data at the national and international level.
Personal information we collect:
We may collect personal information including, but not limited to, identification details (such as name, ID number, passport), contact information (address, telephone number, email), financial and payment data, employment details, and other relevant information necessary to fulfill the purposes outlined in this privacy notice. Rights of the Data Subject
K2 in all data processing will respect the rights of the data subjects. For the purposes of this policy, the data subject will have the following rights:
To know, update, and rectify their personal data against those responsible for processing or in charge of processing. This right may be exercised, among others, against partial, inaccurate, incomplete, fractioned data that leads to error, or those
whose processing is expressly prohibited or has not been authorized in accordance with the regulations that govern, add, execute, complement, modify, repeal, or revoke.
To request proof of the authorization granted to K2 unless expressly exempted as a requirement for the processing.
To be informed by the data controller or the processor, upon the data subject's request, about the use of their personal data.
To revoke at any time the authorization and/or request the deletion of the data when the processing does not respect the principles, rights, and constitutional and legal guarantees.
The right to restrict processing.
The right to data portability, if technically feasible and reasonable in cost.
The right to object when there is a legal or contractual cause.
Rights in relation to automated decision making and profiling.
The right to opt-out of receiving targeted advertising.
In accordance with the purpose of this statement, the data subject, in relation to their non-public data, has the right to knowledge, access, rectification, updating, revocation, and/or deletion of their data at any time.

To guarantee the data subject, at all times, the full and effective exercise of the right to personal data processing.
To request and keep, under the conditions provided in the regulatory decrees and othernorms that modify or reform them, a copy of the respective authorization granted by the data subject.
To properly inform the data subject about the purpose of the collection and the rights that they have by virtue of the authorization granted.
To keep the information under the necessary security conditions to prevent its alteration, loss, consultation, unauthorized or fraudulent use or access.
To ensure that the information provided to the processor is truthful, complete, accurate, updated, verifiable, and understandable.
To update the information, timely communicating to the processor, any new developments regarding the data that had previously been provided and to adopt other necessary measures to ensure that the information supplied to them remains updated.
To rectify the information when it is incorrect and communicate, through the available and most expedient means of communication, the pertinent information to the processor.
To process queries and claims made in the terms indicated in the law.
To adopt an internal manual of policies and procedures to ensure proper compliance with the law and especially, for the attention to queries and claims.
To inform, through the available and most expedient means of communication, the processor when certain information is under discussion by the data subject, once the claim has been made and the respective process has not been completed.
To inform at the request of the data subject about the use of their data.
To inform the data protection authority when security codes are breached and there are risks in the management of the data subjects' information.
Data Privacy Purposes
The following purposes for the processing of information are established according to the profile and/or role:
Processing and management of data as a client or user of K2.
To offer, through own means or together with third parties, information about new product launches and/or benefits.
Additional information that benefits the operation and/or manipulation of our products in case of inconveniences or failures.

To send communications related to K2's commercial activities, news, and useful information for professional practice, products, offers, innovations, invitations to events, job offers, advertising, and/or surveys about our products and services and/or those of our commercial partners.
For statistical purposes, marketing, or relational analysis of information, research, innovation, and development of new products and/or services.
To share, including the transfer and transmission of personal data, to third countries for purposes related to the operation.
Use for security and protection matters within the company's facilities.
Sending correspondence.
Use for legal, administrative, and commercial purposes.
Reporting to control entities.
Use for commercial purposes the emails, text messages (SMS and/or MMS), or any analogous or digital means of the data subjects.
Use and processing of the image to iijnclude them in photographs; procedures analogous to photography; audiovisual productions (videos); as well as Copyrights; Related Rights and in general all those intellectual property rights related to the right of image.
Collected information may be shared with third parties such as cloud solution providers, who facilitate—among other services—the hosting and protection of data to ensure its availability and security. We also share information with companies specializing in email and SMS delivery to manage user communications, including marketing, and with strategic partners who contribute to the provision of our services. All such sharing is conducted under strict confidentiality and security measures, and in accordance with applicable data protection regulations to safeguard the privacy of our users.

Security and Privacy of Data
K2, applying the principle of security in data processing, will provide the necessary administrative and technological measures to ensure the security of the records, preventing their alteration, loss, consultation, unauthorized or fraudulent use or access.

TERMS AND CONDITIONS OF USE - K2 XPERIENCES
The commercialization and provision of experience packages (including travel, cruises, cultural and sporting events) by K2 Investments (hereinafter, "K2" or "The Company") is governed by the following terms and conditions, which you expressly accept by using these services.
1. Definitions 1.1. "K2" or "The Company": Refers to K2 Investments, which organizes and facilitates the Experiences. 1.2. "Experience": Refers to the package of services, travel, or activity offered by K2. 1.3. "Experience User" or "User": Refers to the individual participating in the Experience and their companion(s). 1.4. "Service Provider": Refers to the independent entity providing the final services, such as airlines, hotels, cruise lines, or event organizers.
2. Included and Excluded Services 2.1. Included Services: The price of the Experience includes only those services explicitly stated in the package description. 2.2. Excluded Services: Any other service not detailed in the description is excluded. By way of example, the following are not included: internet services, massages, spa treatments, personal purchases, medical services, or unspecified tips.
3. Experience Conditions and Cancellation Policy The Experience is personal, non-transferable, and non-redeemable for cash, credit, or other services. Once confirmed, the Experience cannot be canceled, modified, or changed in any way. Under no circumstances will full or partial refunds be issued. Failure to appear at the indicated time and date will be considered a waiver of the Experience with no right to compensation or refund. No refunds will be given for any unused portion of a trip once the tour has begun, even if the user leaves the tour for any reason or is excluded.
4. Modifications and Cancellations by K2 K2 Investments reserves the right to modify planned itineraries, travel dates, hotels (of similar or higher category), transportation, and other aspects as necessary for the development of the trip, either before or during it. K2 also reserves the right to cancel the Experience for operational, commercial, or safety reasons, or due to Unavoidable and Extraordinary Circumstances. In case of any modification or cancellation by K2, the User shall not be entitled to any additional compensation.
5. Travel and Health Requirements 5.1. Travel Documents: It is the sole responsibility of the Experience User to obtain and carry valid passports, visas, and other travel documents (valid for at least 6 months after return). K2 is not responsible if boarding or entry is denied due to missing documentation. 5.2. Health and Fitness to Travel: The User guarantees they are in suitable health to travel safely. If the User has any condition that may limit their full and safe participation or endanger themselves or others, they must refrain from participating. 5.3. Travel Insurance: The User is responsible for ensuring that both they and their companions have adequate medical and general liability insurance. The insurance must be valid in the destination country(ies) and cover the full duration of the trip.
6. Limitation of Liability 6.1. Third-Party Service Providers: K2 acts solely as a facilitator in organizing Experiences. The provision of final services (such as but not limited to air and ground transport, accommodation, cruises, tours, and activities) is the sole responsibility of independent Service Providers. Therefore, K2 is not liable for the acts, errors, omissions, representations, guarantees, or negligence of such providers. Any claims must be directed to the respective Service Provider. 6.2. Exclusion of Damages and Responsibility for Belongings: K2 will not be liable for lost profits, income, use, contracts, opportunities, or other direct, consequential, or indirect damages. The User is solely responsible for their personal belongings. K2 is not responsible for the loss, theft, or damage of valuables or any other personal item. 6.3. User Acts: K2 is not liable for damages, losses, or injuries resulting from the User’s own lack of skill, negligence, fault, or failure to follow instructions. 6.4. Monetary Liability Cap: If K2 or Mastercard is found liable, their total cumulative liability will not exceed the total value of the relevant Experience package. 6.5. Force Majeure: In the event of force majeure preventing execution of the Experience, K2 will not be liable for any resulting damages. All obligations will be suspended during the event, with no liability. Once the situation is resolved, K2 will make its best effort to resume the activity. Such events include but are not limited to: war, riots, labor disputes, terrorism, natural disasters, epidemics, pandemics, or any other event beyond K2’s reasonable control. 6.6. Third-Party Information: K2 displays information provided by Service Providers but does not guarantee its accuracy, completeness, or availability.
7. Experience User Responsibilities 7.1. Following Instructions: Users must follow the instructions and orders of staff and comply with conduct policies and general transportation terms. 7.2. Conduct: The User’s behavior must not endanger the safety, peace, or enjoyment of others. K2 or the Service Provider may deny or remove a User whose conduct is considered objectionable, including unlawful or inappropriate behavior. The User will bear all costs arising from their exclusion. 7.3. Damages: The User is responsible for any damage to facilities, furniture, equipment, injuries, or losses to others, as well as fines or penalties incurred. 7.4. Indemnification: The User agrees to indemnify K2, Mastercard, and Service Providers from any damages, fines, costs, or expenses (including reasonable attorneys’ fees) arising from their breach of these Terms, violation of laws, third-party rights, or misuse of the Service.
8. Personal Data Protection and Image Rights K2 is committed to protecting Users' personal information and avoiding its misuse. Personal data will be processed solely to fulfill the Experience, and the User authorizes its disclosure to third parties. Data will be handled according to K2’s and/or Mastercard’s Privacy Policy (if applicable). The User has the right to access, update, rectify, and delete their personal data.
By participating in the Experience, the User grants K2 and Mastercard a non-exclusive, perpetual, worldwide, royalty-free license to use any photographs, videos, or recordings in which they appear, taken during the Experience, for promotional, marketing, and commercial purposes.
10. General Provisions 10.1. Governing Law and Jurisdiction: These Terms of Use are governed by the laws of the State of Florida, USA, without regard to conflict of law principles. 10.2. Modifications: K2 reserves the right to amend these Terms of Use at any time. Continued use of services after such changes constitutes acceptance of the updated Terms. 10.3. Severability: If any provision is deemed invalid or unenforceable, it will be severable and not affect the validity of the remaining provisions. 10.4. Assignment: K2 may assign, subcontract, or delegate its rights and obligations under these Terms at any time. The User may not do so. 10.5. Electronic Communication: The use of electronic means for communication, general and specific terms, is expressly accepted.
